LiveLife Terms and Conditions For South African Hockey Association Supporters Card

1.

DEFINITIONS AND INTERPRETATION

 

1.1

Unless otherwise expressly stated, or the context otherwise requires, the words and expressions listed below shall, when used in these terms and conditions, bear the meanings ascribed to them:

 

  1.  LiveLife are the exclusive loyalty solutions provider to South African Hockey and the South African Hockey Supporters Card.
  2. The South African Hockey Supporters card allows users to benefit from the LiveLife retail partner base.
  3. The South African Hockey Supporters card can be purchased for R120 and is valid for 12 months from date of purchase and registration.

Should you not renew your South African Hockey supporters card at the end of the 12 month period the benefits will no longer be available.

 

 

1.1.4

Earn partner means an institution that we have contracted with to provide you with LiveLife points based on eligible spend.

 

 

1.1.5

Effective Date in respect of each Member, means the date on which that Member registers for the LiveLife Discount Rewards Programme and is accepted and assigned a LiveLife Account by LiveLife.

 

 

1.1.6

LiveLife means LiveLife Loyalty Programmes (Pty) Ltd, a limited liability company established under the laws of the RSA, with registration number 2004/027373/07.

 

 

1.1.7

LiveLife Discount Rewards Programme means the LiveLife Programme established by LiveLife for purposes of providing the Loyalty Benefits to Members.

 

 

1.1.8

LiveLife Partner means those merchants and/or suppliers and/or service providers approved and appointed by LiveLife, in its sole and absolute discretion from time to time, to participate in the LiveLife Discount Rewards Programme, as partners for purposes of the Loyalty Benefits.

 

 

1.1.9

LiveLife Points means the LiveLife Discount Rewards Programme "currency" i.e: points earned by a Member for Transactions effected by a Member from time to time.

 

 

1.1.10

LiveLife Account means a virtual account that is assigned by LiveLife to each Member for the purposes of accessing and enjoying Loyalty Benefits.

 

 

1.1.11

Loyalty Benefits means the benefits that a Member is entitled to enjoy, including the ability to earn and redeem LiveLife Points, to access any bonuses, special rates, offers, exclusive access to product launches and any other incentives that may be offered by any LiveLife Partner and/or LiveLife, from time to time.

 

 

1.1.12

Member means any person who has registered as a Member of the LiveLife Discount Rewards Programme, in accordance with these terms and conditions and has been assigned a LiveLife Account.

 

 

1.1.13

Parties means each Member and LiveLife and 'party' means any of them as the context may require.

 

 

1.1.14

RSA means the Republic of South Africa

 

 

1.1.15

Spend partner means an institution that we have contracted with to provide you with goods and/or services on the LiveLife Programme.

 

 

1.1.16

Transaction means any purchase effected by a Member at any shop, online, via e-commerce, outlet or store owned or operated or managed by a LiveLife Partner by using or uploading his LiveLife Account at the point of sale operated by the LiveLife Partner, excluding, without limitation, any refund or reversal of payment or other fees and charges levied by LiveLife in respect of products and/or services provided from time to time and which rewards the Member eligible for LiveLife Points in terms of the LiveLife Discount Rewards Programme.

 

1.2

Unless the context clearly indicates a contrary intention –

 

 

1.2.1

an expression which denotes any gender includes the other genders, a natural person includes an artificial person and vice versa and the singular includes the plural and vice versa.

 

 

1.2.2

where any term is defined within a particular clause, other than the definition clause, that term shall bear the meaning ascribed to it in that clause wherever it is used in these terms and conditions.

 

1.3

Should any provision in a definition be a substantive provision conferring rights or imposing obligations on any party, then effect shall be given to that provision as if it were a substantive provision in the body of these terms and conditions.

 

1.4

Any reference to an enactment, regulation, rule or by-law is to that enactment, regulation, rule or by-law as at the Effective Date, and as amended or replaced from time to time.

 

1.5

When any number of days is prescribed, such number shall exclude the first and include the last day.

 

1.6

Any schedule or annexure to these terms and conditions shall form part of this agreement.

 

1.7

The use of the word "including" followed by a specific example/s shall not be construed as limiting the meaning of the general wording preceding it and the ''eiusdem generis rule'' shall not be applied in the interpretation of such general wording or such specific example/s.

 

1.8

The rule of construction that a contract shall be interpreted against the party responsible for the drafting or preparation of the agreement shall not apply nor shall these terms and conditions be construed in favour of or against any party by reason of the extent to which any party or its professional advisors participated in the drafting or preparation of these terms and conditions.

 

1.9

Recordals shall be binding on the parties and are not merely for information purposes.

2.

INTRODUCTION

 

2.1

LiveLife has established a LiveLife Discount Rewards programme for its customers and the general public, in terms of which, it will offer and provide Loyalty Benefits to those customers and persons who join the LiveLife Discount Rewards Programme, as Members.

 

2.2

These terms and conditions form the basis of the LiveLife Discount Rewards Programme and are intended to regulate the relationship between Members and LiveLife.

 

2.3

It is the Member's responsibility to read and understand these terms and conditions.

 

2.4

Every Member is subject to these terms and conditions and is deemed to have read and unconditionally accepted these terms and conditions.

3.

ELIGIBILITY, REGISTRATION AND PARTICIPATION

 

3.1

LiveLife shall be entitled, in its sole and absolute discretion, to determine who is eligible to become a Member of the LiveLife Discount Rewards Programme.

 

3.2

Subject to 6, any person may register to become a Member in any of the following ways, by –

 

 

3.2.1

logging onto the LiveLife website (www.livelifetoday.co.za) and completing and submitting the online application form.

 

 

3.2.2

registering at any LiveLife Partner terminal.

 

3.3

No person other than a Member shall be entitled to participate in the LiveLife Discount Rewards Programme.

 

3.4

Any person, whose membership has, in the last 2 (two) years been terminated or cancelled by LiveLife for default and/or breach of these terms and conditions, shall not be eligible to become a Member of the LiveLife Discount Rewards Programme.

 

3.5

Each Member acknowledges that

 

 

3.5.1

he is aware that LiveLife has contractual arrangements with LiveLife Partners in the LiveLife Discount Rewards Programme but that it is at all times within LiveLife's sole and absolute discretion whether or not and in what manner it enforces any of its rights in terms of any such contractual arrangements; and

 

 

3.5.2

it has no rights against LiveLife if a LiveLife Partner in any manner breaches its contractual obligations to LiveLife or refuses to grant that Member any Loyalty Benefits or grants a Loyalty Benefit different to which the Member expected.

 

3.6

The Member will be eligible to participate in any competitions arranged or organised by LiveLife and/or the LiveLife Partners pursuant to or in connection with the LiveLife Discount Rewards Programme, provided that no employees of LiveLife or the LiveLife Partner/s (or their immediate families) shall be eligible to enter any competition. Prizes awarded in terms of the LiveLife Discount Rewards Programme are not transferable and have no monetary exchange value and may not be converted to cash.

4.

DORMANT LIVELIFE ACCOUNTS

 

4.1

If you do not earn any LiveLife points for a period of 6 (six) months, your LiveLife account will be considered dormant.

 

4.2

We will send you a reminder that your LiveLife account will become dormant.

 

4.3

When your LiveLife account becomes dormant, it will be closed and you will forfeit all your LiveLife with immediate effect.

 

4.4

You may reopen your LiveLife account within 3 (three) months of the closure thereof by calling our call centre.

 

4.5

Your forfeited LiveLife points will be credited to your account in the event that your LiveLife account is successfully reopened.

5.

EARNING LIVELIFE POINTS

 

5.1

LiveLife Points may only be earned and accumulated with effect from the Effective Date. LiveLife will not be obliged to award LiveLife Points for Transactions effected prior to the Effective Date.

 

5.2

A Member can earn LiveLife Points at any LiveLife Partner specified by LiveLife from time to time.

 

5.3

Subject to 4.6 below, LiveLife Points will be accumulated directly to a Member's LiveLife Account as soon as the Transaction is recorded at a LiveLife Partner's point of sale.

 

5.4

The Member agrees that LiveLife Points are neither negotiable nor transferable. However, LiveLife Points may be transferred for redemption purposes between immediate family members, subject to LiveLife's approval and in accordance with the provisions of 5 below.

 

5.5

A Member may not sell, issue, exchange, barter or redeem LiveLife Points for cash.

 

5.6

LiveLife Points may take up to 30 (thirty) days from the date upon which any Transaction is effected by a Member to reflect on a Member's LiveLife Account and become effective. In the event that LiveLife Points are not reflected within this period, the Member must contact LiveLife requesting the LiveLife Points to be credited. If LiveLife receives no written objection concerning the allocation of LiveLife Points within 7 (seven) days from the expiry of the 30 (thirty) day period, any Transaction and allocation of LiveLife Points reflected in such LiveLife Account shall be deemed to have been approved and ratified by the Member.

 

5.7

LiveLife Points may be transferred into or used to purchase a gift voucher.

 

5.8

A member will earn LiveLife Points as a percentage back on the total transaction value at a LiveLife Discount Rewards Partner store. This percentage reward may vary from partner to partner.

 

5.9

LiveLife reserves the right, at its election, to refuse to record or honour and to cancel or reverse any LiveLife Points earned or accumulated if

 

 

5.9.1

the LiveLife Points were awarded in error and/or accumulated by the Member as a result of fraud or pursuant to any illegal, ineligible or unauthorized Transaction;

 

 

5.9.2

a Transaction has not been fully settled by the Member or if Transactions have been reversed; or

 

 

5.9.3

the Member's participation in the LiveLife Discount Rewards Programme is cancelled or revoked in terms of 7. 

 

5.10

The Member needs to follow the Partner Store's refund policy for any returns or refunds. LiveLife will refund LiveLife Points within 30 (thirty) days of the purchase but would be governed by the Partner's refund policy should it be less than 30 (thirty) days.

 

5.11

Any cancellation/reversal of LiveLife Points, in terms of 4.9 above, will be reflected on the Member's LiveLife Account. If LiveLife Points are cancelled, reversed or for any reason become void the Member shall not be compensated therefore and such LiveLife Points shall not be redeemed.

 

5.12

There are no limits on the number of LiveLife Points that a Member can earn at any given time.

 

5.13

LiveLife Points will not accrue to or be earned by a Member in respect of goods or services that have been discounted by a LiveLife Partner.

 

5.14

LiveLife reserves the right to make certain products or services exempt from earning LiveLife Points.

 

5.15

LiveLife Points shall be valid for a period of 36 months from the date on which they are earned by a Member.

6.

REDEEMING LIVELIFE POINTS

 

6.1

A Member shall be entitled to redeem LiveLife Points earned and accumulated in respect of Transactions for Loyalty Benefits, provided his/her LiveLife Account is in good standing.

 

6.2

A Member shall not be entitled to countermand, cancel or amend any redemption request referred to in 5.1 once received and/or effected by LiveLife or a LiveLife Partner (whichever event is the earlier), without LiveLife's prior written consent.

 

6.3

A Member shall not be entitled to reverse, exchange, barter, sell or claim any refund or any Loyalty Benefits or voucher, nor shall the Member be entitled to convert any Loyalty Benefits or voucher back into LiveLife Points for any reason whatsoever, regardless of whether the Loyalty Benefits and/ or voucher has not been used or has expired.

 

6.4

A Member shall bear all risk and liability for any Loyalty Benefit or voucher received in terms of the LiveLife Discount Rewards Programme and to the extent that there is any dispute regarding any Loyalty Benefits or voucher, such dispute must be settled between the relevant LiveLife Partner and the Member directly.

 

6.5

In the event that a Loyalty Benefit or voucher is lost, stolen, destroyed or otherwise cancelled by any law, government action or similar event beyond the control of LiveLife, LiveLife shall not be liable howsoever to replace such Loyalty Benefit or voucher or to reimburse the Member with the equivalent number of LiveLife Points as were redeemed.

 

6.6

Loyalty Benefits are subject to availability and in accordance with such restrictions, limitations, rules, procedures, charges or exclusions as may be applicable in respect thereof from time to time. All reservations and/or other arrangements relating to the Loyalty Benefits must be confirmed by the Member directly with the LiveLife Partner and the Member shall be obliged to comply with the LiveLife Partner's Loyalty Benefit terms and conditions with effect from the redemption date. The Member shall be solely responsible to ensure that the Member is familiar with the Loyalty Benefit terms and conditions of all LiveLife Partners and for any cost, charge or expense incurred pursuant to the redemption of LiveLife Points in terms of the LiveLife Discount Rewards Programme.

 

6.7

LiveLife provides no guarantees, warranties or representations regarding the LiveLife Partners, their agents, employees or directors, their status, eligibility, processes, products, Loyalty Benefits, performance, services, systems or otherwise howsoever and the Member agrees that all risk relating to the LiveLife Partners participation in the LiveLife Discount Rewards Programme shall be borne by the Member.

 

6.8

The number of LiveLife Points required for a Loyalty Benefit may be varied from time to time by LiveLife in its sole and absolute discretion.

 

6.9

Members will not in any way be precluded, limited, blocked, restrained or prohibited from enjoying any of the Loyalty Benefits.

7.

FEES

LiveLife shall be entitled to charge and recover from the Member an administration fee in relation to every Transaction that is effected by a Member. The cost of such administration fee will be communicated to the Member by LiveLife from time to time. In such event, the Member hereby authorises LiveLife, at its discretion to debit the Member's LiveLife Account with the fee (inclusive of Value Added Tax) applicable from time to time.

 

7.1

LiveLife shall charge the member a monthly administration fee of 5% of your Discount Rewards balance of R 0.01 or more on the 28thof each month.

 

7.2

The card balance will not be placed in arrears if there are insufficient points (less than 1 LiveLife Point) on the card. In this case, the points balance will be cleared and reverted to 0 (zero).

8.

YOUR RIGHTS AND OBLIGATIONS

 

8.1

You must comply with any terms of use, terms and conditions of the disclaimer and privacy policy, which are all available on our website.

 

8.2

Our website will be the definitive source for updated information.

9.

OUR RIGHTS AND OBLIGATIONS

 

9.1

We may use, consistent with our privacy policy, any personal information for marketing purposes at our discretion if you marked the appropriate box on your LiveLife application form.

 

9.2

We will do our utmost to ensure our call centre is available to you during the hours specified by us from time to time.

10.

TERMINATION

 

10.1

LiveLife may, at any time, for any reason, but on notice to the Member, terminate a Member's participation in the LiveLife Discount Rewards Programme. The Member will have 30 (thirty) days to spend any LiveLife Points that have been accumulated, unless –

 

 

10.1.1

LiveLife believes that the Member's behaviour was inappropriate, constituted misconduct and/or is considered an abuse of the LiveLife Discount Rewards Programme;

 

 

10.1.2

the Member has breached these, or any other, terms and conditions relevant to the LiveLife Discount Rewards Programme; or

 

 

10.1.3

a fraudulent Transaction was conducted directly or indirectly by such Member, in which case, LiveLife reserves the right and without prejudice to any of its other rights and remedies in terms of these terms and conditions and in law, to be exercised in LiveLife's sole discretion, to

 

 

 

10.1.3.1 procure that that Member forfeits all its LiveLife Points in its LiveLife Account;

 

 

 

10.1.3.2 immediately terminate that Member's membership to the LiveLife Discount Rewards Programme;

 

 

 

10.1.3.3 permanently disqualify that Member from accessing any discounts; and/or

 

 

 

10.1.3.4 reverse/cancel any Transaction relating to the aforementioned conduct and hold that Member liable for any value which that Member has received in terms of such conduct.

 

10.2

If LiveLife terminates a Member's participation in the LiveLife Discount Rewards Programme, LiveLife will not be liable for any damages of any nature suffered by the Member or any third party.

 

10.3

Any Member may terminate its participation in the LiveLife Discount Rewards Programme on 30 (thirty) days prior written notice to LiveLife.

 

10.4

During this notice period, the Member may spend, donate or transfer his/her LiveLife Points to any other LiveLife Accounts, failing which that Member will forfeit all the LiveLife Points in that Member's LiveLife Account when it is closed.

 

10.5

Every Member accepts that LiveLife may, in its sole and absolute discretion, from time to time amend, replace, withdraw or substitute the LiveLife Discount Rewards Programme, or suspend any of the LiveLife Partners or any aspect thereof or the terms and conditions relating thereto, without incurring any liability whatsoever. LiveLife shall give the Members notification of any such amendment, termination, withdrawal or substitution on its website (www.livelifetoday.co.za) or through any other medium that LiveLife may deem fit. No alteration, amendment or termination of the LiveLife Discount Rewards Programme will affect any LiveLife Points that have been accumulated at the time.

11.

LIABILITY AND INDEMNITY

 

11.1

You must keep your password and LiveLife membership number confidential and, in the event that you have compromised such information, we will not be liable for any loss or damage suffered by you in any way whatsoever.

 

11.2

Although we carefully select our partners, you will carry the risk for any fraud or losses that occur via our partners’ websites.

 

11.3

We will incur no liability if a dispute arises between you and a partner in respect of goods or services purchased. You acknowledge that none of the partners are our agents.

 

11.4

11.5

We are not liable for any acts or omissions by third parties, including without limitation an internet service provider, a telephone provider or partner relating to the use of the LiveLife Programme.

 

11.6

We will under no circumstances be liable for any consequential, incidental, special or direct loss or damage resulting directly or indirectly from these terms and conditions or your participation in the LiveLife Programme.

 

11.7

You hereby indemnify us against any claims by third parties or losses suffered by you arising from your participation in the LiveLife Programme.

 

11.8

Our partners' websites may be linked to our website, in which case we cannot control or make any representation as to the legal content of such websites, and we will therefore not be liable for the information provided on such websites.

 

11.9

We do not warrant, endorse or make any representations about the contents, product, service or reliability of any third party’s business or security practices and operations.

12.

FORCE MAJEURE

 

12.1

Should LiveLife or any LiveLife Partner be prevented from fulfilling any of its obligations in terms of these terms and conditions as a result of an event of force majeure (as defined in 12.3) then those obligations shall be deemed to have been suspended to the extent that and for so long as LiveLife is so prevented from fulfilling them, and the corresponding obligations of the customer shall be suspended to the corresponding extent.

 

12.2

Should an event of force majeure continue for more than 180 (one hundred and eighty) days, either party shall be entitled (but not obliged) to cancel the relevant order by giving not less than 30 (thirty) days written notice of cancellation to the other party.

13.

INTELLECTUAL PROPERTY

All intellectual property is owned by or licensed to us, and you may not use it without our prior written consent.

14.

PRE-PAID CERTIFICATES, CREDITS AND VOUCHERS

Where a consumer makes an advance payment for goods or services to a supplier and is provided with a prepaid certificate, card, voucher or similar device that device remains valid until its full value has been redeemed in exchange for goods or services; or three years after the date on which it was issued (unless the supplier extends that period), the outstanding credit on the device remains the property of the consumer.

COMPLAINTS AND DISPUTES

 

15.1

Complaints or queries may be directed to our call centre.

16.

ELECTRONIC COMMUNICATIONS AND TRANSACTIONS ACT

 

16.1

You are not allowed to send any notice or legal document to us by email.

 

16.2

In terms of Chapter 3 of the Electronic Communications and Transactions Act, by visiting our website and/or communicating with us by electronic means you acknowledge that all agreements, notices, disclosures and other communication sent by us satisfy any legal requirement including and not limited to the requirement that such communication should be in writing.

 

16.3

Any other communication to you may be sent via the method of communication selected by you on the LiveLife Programme application form and updated by you from time to time.

17.

GENERAL

 

17.1

Apart from the fact that it is possible to link an instruction to a specific account, it is not possible to verify the actual originator, and you therefore authorise us to act on any instruction purporting to originate from you even if it transpires that both you and us have been defrauded by someone else, unless you have informed us to the contrary prior to us actioning a transaction.

 

17.2

No failure, delay, relaxation or indulgence on our part in exercising any power or right conferred upon us under these terms and conditions will operate as a waiver of such power or right nor will such failure, delay, relaxation or indulgence be deemed to be part of any of these terms and conditions.

 

17.3

You may not cede, delegate or otherwise transfer any rights or obligations arising from these terms and conditions without our prior approval, which approval will be given at our sole discretion.

 

17.4

If any of these terms and conditions are found to be invalid or unenforceable, such terms and conditions will be severable from the remaining terms and conditions, which will remain of full force and effect, and we will be entitled to vary and update all terms and conditions relating to the LiveLife Programme.

 

17.5

Each time you use the LiveLife Programme the version of the terms and conditions current at that time will apply to that transaction.

 

17.6

You hereby acknowledge that you have familiarised yourself with the current terms and conditions, which will be displayed on our website and which will in addition be hosted by our call centre.

18.

REPORTING LOST OR STOLEN CARD

Should your LiveLife card be lost or stolen, notify the LiveLife Call Centre on 0861378886. A new card can be obtained from any participating LiveLife partner. The current card balance will be transferred to your replacement card.
